| Terms & Conditions
1. Fees are as agreed as detailed
in the contract booking. Earlier set up times and longer
performance times to those specified above will attract
an extra fee and must be agreed in advance. All other
methods of payment will be by mutual agreement.
2. This contract reflects the
verbal agreement, and shall include any terms and conditions
agreed prior to its issue, and shall be deemed accepted
unless a written objection is received within 7 working
days of the issuing date. No alterations may be made
to this contract by, either the Client or the Artiste(s)
without prior approval by Agency Planitology or the
Artiste(s).
3. In the event of the Client
wishing to cancel the event, for any reason, any advance
payment made will be forfeited and the whole of the
agreed fee will be payable to the Artiste(s) subject
to contract.
4. In the event of the Artiste(s)
being unable to honour the contract the Artiste(s) will
indemnify Agency Planitology against the cost of loss
and or damage in full to the client. If due to accident
or sudden illness a medical certificate signed by a
medical practitioner, must be supplied to the Client
and Agency Planitology, within ten working days.
5. Every reasonable safeguard
is assured but if due to (1) Act of God or (2) National
Disaster or (3) Severe weather or (4) Sudden equipment
failure or (5) an Artist (s) is unable to complete a
performance, a refund will apply unless an alternative
Artist(s) can be found. Refunds or compensation will
not exceed the sum of the contracted amount.
6. The Artiste(s) and their assistants
will conduct themselves in a proper manner throughout
their attendance at the venue or event, and will respond
to the Clients requests as to the performance and
any other reasonable requests. The Client will supply
suitable changing facilities where required.
7. Complaints regarding an Artist(s)
or their performance must be dealt with by the Client
and the Artist(s) at the time, not after the event.
Agency Planitology will not be liable or held responsible
under any such dispute. Clients should contact our office
within 24 hours of such an incident (020 7733 2995)
8. Agency Planitology will not
be liable for non- fulfilment of this contract by the
Client and, or the Artiste(s), although every reasonable
precautions will be taken.
9. The Client should allow suitable
time for the setup and dismantling, and removal of
equipment (normally one hour). The Client also ensures
that safe and adequate power is available.
10. The Artiste(s) is responsible
for any equipment that requires connection to a power
source is electrically safe and conforms to the HSE
EAW Act 1989, and (b) that they hold adequate public
liability insurance, which they may be asked to produce
at some venues.
11. Any re-engagement of the Artiste(s)
also any enquiry to the Artiste(s) in respect of any
engagement by guests, customers and, or staff, must
be via Agency Planitology. No personnel cards or telephone
numbers are to be shown or exchanged. Artists will be
in breach of contract accepting direct bookings and
will forfeit their membership with Agency Planitology.
12. The Artiste(s) are responsible
for any Inland Revenue or National Insurance due,
arising from this performance and will indemnify Agency
Planitology from any such liability.
13. The Artiste(s) shall be in
no way liable for breach of byelaws, or conditions
under which the venue is leased, hired or entrusted
to the Client. The Client also ensures that all appropriate
licenses, as required by law, are in force at the
time of the performance(s).
14. The Client will provide adequate
supervision of their guests, customers and staff at
the venue. We reserve the right to terminate the performance
in the event of a disturbance where injury or damage
may occur. In such an event full payment for that
performance together with any damaged equipment will
be payable.
15. Please note your Artiste/Performer
will try to accommodate as many requests as possible,
however, we cannot guarantee to accommodate all requests
in your list or requests given to the Artiste/Performer
at the event.
